On the allocation and optimization of judicial power in the national park system

The development of the national park system is a crucial initiative in advancing the modernization of harmonious coexistence between humanity and nature. Legal frameworks play an essential role in supporting this system. To enhance judicial protection for national parks, some jurisdictional courts have experimented with innovative approaches to allocating judicial authority. This article examines China's national park system, focusing on the current state and distribution of administrative and judicial powers within it. The analysis highlights significant issues, such as inadequate cross-regional jurisdiction and insufficient oversight of administrative authority. Additionally, local protectionism and hierarchical restrictions further undermine the independence and effectiveness of judicial supervision. To address these challenges, it is suggested that judicial jurisdiction rules for national parks be refined by combining specialization with centralization. Furthermore, efforts should be made to improve the consistency and coordination in judicial procedures within national parks by establishing mechanisms for information sharing and collaboration. It is also crucial to clarify the administrative authority of national park management agencies and local public security bodies, fostering joint mechanisms for the protection of national park ecosystems. These measures aim to strengthen judicial protection and thus foster harmonious coexistence between humans and nature.
